A Clive pharmacist has agreed to relinquish ownership of his pharmacy as part of a settlement agreement with state regulators.
Pharmacist Rick Pauley entered into a settlement agreement with the Iowa Board of Pharmacy after being charged with failing to submit timely and accurate prescriptions to the prescription monitoring program, and for dispensing an incorrect prescription.
Pauley is the owner and pharmacist in charge at Five Star Compounding Pharmacy in Clive. Unlike regular pharmacies that provide customers with commercially produced medications in standardized dosages, compounding pharmacies typically customize medications based on individual patients’ specific needs.
The board has alleged that in June 2021, Pauley dispensed prescription capsules that were compounded with an excessive amount of one unspecified active ingredient. Also, a review of 10 controlled-substance prescriptions dispensed by Pauley indicated that none of the 10 were accurately submitted to the board’s prescription monitoring program.
The board issued Pauley a citation for dispensing an incorrect prescription to a canine patient and it imposed a civil penalty of $2,000.
Within 90 days, Pauley must terminate his ownership of any Iowa pharmacy and he is barred from serving as the pharmacist in charge at any Iowa-licensed pharmacy. He also must complete 12 hours of continuing education to maintain his license.
More pharmacy board actions
In other recent actions, the board entered into an agreement with eastern Iowa pharmacist Scott Decker, who has agreed not to practice pharmacy until the criminal charges he is now facing are resolved.
Court records indicate that earlier this year, Scott County deputies were granted a search warrant for Decker’s email account and his cell phone after it was determined that an email address associated with Decker was connected to the uploading of 18 photographic images that allegedly constitute child pornography.
In August, Decker was charged with two counts of felony sexual exploitation of a minor. A jury trial has been scheduled for Feb. 28, 2022. In return for his promise to suspend his practice while those charges are pending, the board has agreed not to pursue formal disciplinary action against Decker until the case is resolved.
The Board of Pharmacy has also entered into a settlement agreement with Scott’s Thrifty White Drug Store of DeWitt. The settlement follows allegations that the pharmacy failed to establish and maintain effective controls against the theft or diversion of prescription drugs and controlled substances.
The board placed the pharmacy’s license on probation for one year and imposed a civil penalty of $3,000.
According to the board, the pharmacy lost “a significant amount” of codeine phosphate, a Schedule 3 controlled substance. The loss was attributed to employee theft.
